Terms of Use

1. About these terms
These terms govern your use of the iOS app known as Kinwise (and its names in other languages, the "App") provided by ForgeLab, a sole proprietorship run by Jason Lee ("we"). Apple's Standard Licensed Application End User License Agreement (EULA) also applies to apps downloaded from the App Store; where these terms differ, these terms prevail to the extent permitted by law.
2. The service
The App lets you record the names, faces, birthdays and relationships of your family, relatives, friends and coworkers, shows the appropriate form of address for each relationship, and helps you remember them with quizzes and reminders.
3. Forms of address are guidance
Forms of address follow the Standard Korean Language Etiquette of the National Institute of Korean Language for Korean, and widely used standard usage for other languages. Real usage varies by region, family, age and closeness. Treat the App's suggestions as guidance and agree with your family on what to use; you can set your own word in the App.
4. Not a medical app
The App is a general memory aid. It is not a medical device or medical service and is not intended to diagnose, treat, prevent or manage dementia or any other condition, nor to replace professional advice.
5. Your responsibilities
- When you record information about other people, record only what you need and respect their wishes. Delete it if they ask you to.
- Do not use the App to harass, secretly monitor, discriminate against or harm anyone, or for any unlawful purpose.
- People you invite to co-edit can view and change the shared family. Invite only people you trust.
- We recommend a device passcode and the App lock in case your device is lost.
6. Paid features
- Without a pass, you can use the family map, forms of address, quizzes, photos, widgets, reminders and co-editing for free for one family you created, with up to 10 people. Exporting to files, such as the family map image and PDF, the family info file and the print text, requires a pass.
- The passes are Kinwise Pro Lifetime (a one-time, non-consumable in-app purchase) and Kinwise Plus (a monthly or yearly auto-renewable subscription). Either one unlocks every feature currently in the App, including no people limit, the event prep helper and exporting to files. If we offer co-editing through our servers in the future, it will not be included in Lifetime Pro.
- 7-day free trial: the trial starts when you tap "Get started" on the trial notice in the App or close the notice, and for 7 days you can use every feature as if you had a pass. The trial needs no payment details, and nothing is charged when it ends. The trial is available once per Apple Account.
- If you no longer have a pass because a trial or subscription ended or a purchase was refunded, any family you created with more than 10 people cannot be viewed or edited until you have a pass again. The same applies if you import a backup of a large family without a pass. Your information is not deleted, automatic backups continue, and the family reopens as soon as you have a pass.
- Payment, renewal, cancellation and refunds are handled by Apple under its policies. Subscriptions renew automatically at the same price unless canceled at least 24 hours before the end of the current period; manage them in Settings > Apple Account > Subscriptions. Subscriptions do not include an App Store free trial; the App's 7-day free trial is not a subscription and never turns into a paid one. Lifetime Pro is charged once and never renews. Refund requests go to Apple at reportaproblem.apple.com.
- Use "Restore purchases" with the same Apple Account after reinstalling or changing devices.
- We will give notice before changing prices or plans.
7. Your data and backups
In version 1.x your information is stored on your device and in your iCloud; we do not hold it. With or without a pass, the App keeps automatic backups of your families on your device and, if you use iCloud Drive, in your iCloud Drive, and you can restore them from Settings > Automatic backups. If you have a pass, we also recommend keeping a file copy using Settings > Export family info to protect against device, iCloud account or storage problems. Our Privacy Policy describes how information is handled.
8. Changes and discontinuation
We may update the App and change features. If we stop offering the App, we will give at least 30 days' notice and make sure you can export your information.
9. Intellectual property
We own the rights to the App's software, design, illustrations, text and form-of-address rules. You own the information you enter.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect damages, misunderstandings arising from differences in forms of address, or data loss caused by device or iCloud issues, except for damage caused by our intent or gross negligence.
11. Governing law
These terms are governed by the laws of the Republic of Korea. We will first try to resolve any dispute in good faith. Nothing in these terms limits rights you have as a consumer under the mandatory laws of your country of residence.

13. Android app
These Terms also apply to the Android app from Google Play; this section applies from the day the Android app is released on Google Play. For the Android app, the Google Play Terms of Service also apply, and the following replaces the parts above about Apple, iCloud and co-editing.
- The Android app does not offer co-editing. Your information is stored on your device and, if you turn it on, in your phone's Google backup; we do not hold it. With or without a pass, the app keeps automatic backups on your device (Settings > Automatic backups), and if you have a pass we recommend also keeping a file copy using Settings > Export family info.
- The Android app sells Kinwise Pro Lifetime (a one-time in-app purchase that never renews) and Kinwise Plus (a monthly or yearly auto-renewable subscription). What is free, what a pass unlocks, the 7-day free trial and when a family is locked work as described in section 6. The free trial can be used only once.
- Subscriptions are charged to your Google Account and renew automatically at the same price before the end of each period unless canceled. You can cancel anytime in Google Play Store > Profile > Payments & subscriptions > Subscriptions.
- Payment, renewal, cancellation and refunds are handled by Google Play under its policies and procedures. You can request a refund through Google Play; for anything else, contact us at the address in section 12.
- Use "Restore purchases" with the same Google account after reinstalling or changing devices.
